Do you have one or two pink wires at the switch? If one, the other side needs to be earthed at the switch
If the loom is new is it to original spec Li3 or something else?
What sort of regulator / junction box are you using?

It sounds like you have more than 1 fault.
A common reason for the brake light looking like it isn't working is the rear light has been wired up back to front
Ie brake light circuit is wired up to the back light circuit and vice versa,
The way to check this is take the lens off and watch the lamp filaments light up.
When the back light is on, one filament should be lit
Hit the back brake and both filaments should light.
If this is the case then swap the supplies over in the back light and it should work correctly.
That won't cure you back light being on all the time
If your back light is on all the time it sounds like you have it wired directly into the feed from the stator so re check the wiring of the rear light circuit.
My personal set up when rewiring a scoot is to build up the wiring in stages
Ignition circuits first
Then the horn and brake light
Then the lights
Hope this helps

its a 2 pin brake switch ......the new loom [same as a scootopia one ] has pink and brown wires to switch ...pink from rear lamp [stop] and brown from regulator that goes from switch to front bulb holder/junction at rear of headlamp this is connected with a brown to ign switch and a purple also from ign switch the horn feed [brown ]piggy backs from this .....this seems to be correct with wiring diagrams am baffled as everything else is working fine
phil p.s am using bgm regulator the latest small ones

So the fault was that there was nothing to press the switch, priceless.
Glad you got it sorted.
